Dealing with Your Insurance Company

 

In assisting our clients with claim submissions and appeals, we are frequently called upon to respond to and speak with our clients' insurance companies, claim reprentatives, and other persons employed to administer the claims.  However, many of our clients prefer that we communicate in their behalf, generally, so as to reduce the stress and aggravation of such communications.  For example:

  • Settlement Negotiations:  For example, your insurance company has contacted you to offer a lump sum payment in exchange for all future benefits under your disability plan.  Similar offers may be made in the course of a health, life, or disability insurance dispute, during the internal appeal, or in the course of litigation.  We can help you to analyze whether the offer is reasonable, and to negotiate with your insurance company to obtain a better settlement. 

Requests for Personal Information, or to Undergo an Independent Medical Examination (IME):  You may be contacted by your insurer and asked to provide information that is difficult to locate, or highly personal in nature - such as old tax returns, psychotherapy records, business diaries, etc.  Or, your insurance company may demand that you undergo a medical examination that you or your doctor find unnecessary, painful, harmful to your health, or otherwise objectionable.  We can advise you with regard to the legality of such demands, and negotiate with your insurance company to ensure that all requests are reasonable and appropriate.
